Which one is legit between these two? Same models, different sellers...

Discussion started by wing688

Ok, here are the two models I found browsing:

https://www.cgtrader.com/3d-models/interior/hall/h...

https://www.cgtrader.com/3d-models/exterior/office...

Who is the legit owner of this model? Clearly two sellers can't be selling the same model.. so...?

Wow, that's really hard to say. I've come up with a few ideas

1. Both accounts are actually the same creator. It's possible they created a new one because of negative feedback or just to upload their item multiple times. Either way is definitely against the rules.

2. One of them is the real owner. Guamwork may buy low cost products and reupload them for a higher price, relying on the high quantity of item in their shop to bring in more traffic to the item. Or Faint3d bought the item and then decided to resell it and undercut Guamwork. Again, both would be against the rules.

3. This building model is in the public domain from another site and thus has "no true owner". Both sellers have decided to sell the asset with the original renders independently. I am unsure whether this breaks any rules, but it is unethical.

Doing a simple image search reveals the item is on numerous sites with different authors:

and...

The free model:

I think the original model is indeed in the public domain and various authors have since uploaded it.

I doubt someone would buy an item only to illegally upload it for free, so I am making the assumption that the public domain asset came before the paid assets. It also includes a more thoughtful display and a render not included in some of the others. To me, that also shows more thoughtful intention from an original creator. Again, if that is the case it does not violate any ownership laws (although that is hard to define internationally), but it may violate CG Trader's terms. I'll bring it to their attention in case other authors are doing this.

I think you forgot 4th option, which more than likely is an actual one - both sellers are crooks and are selling stuff obtained from warez sites. AFAIK guamwork is well known for such behaviour and already was reported multiple times. BTW, if you found something for free on the internet, it not necessarily means that this item is in public domain... ;]
