Someone is selling one of my models in Second llifes marketplace...

I got a heads up about one of my models being sold in the Second Life's marketplace, I checked it out and indeed it is my model, in the description they say it has an animation and sound included.
The Linden Lab marketplace makes it a bit difficult to flag or make a claim and I finally got a form and filled the information and showed the link to my model but now they say it will take two days for review and that I may get charged by attorney fees and extra costs if he does have a license for him to resell my models.

I also sell my models through Turbosquid and Cubebrush, but as far as I know none of those sites let people resell the models either. On Cubebrush I can set a commercial fee, but it says clearly the models can't be resold as stock so I want to know if the licenses here in CGtrader or even turbosquid and cubebrush allow such a thing as to sell models in something like Second Life's Marketplace.

This is a quote from the email they sent:

**The DMCA provides that you may be liable for damages ( including cost
and attorneys fees) if you falsely claim that a resident has infringed
your copyright. Please consult an attorney if you are unsure**

It would be a huge blow if people can resell my models just as easy and then I can't make them stop or face being charged by attorney fees.

Don't let them confuse you with attorneys and fees.
Do you "falsely claim that a resident has infringed your copyright"? Nope.
It's your model and your authorship and you have the rights to complaint.
If anyome has to pay attorney fees, it will be the ones who made illegal actions - the ones who re-sell your property without your consent.

No royalty free license on any marketplace allows customers to buy the assets and resell them on their own. Your link isn't working, but from what you described, it is clear that you're a victim of the fraud. If the model is yours and it is being resold by someone without your permision, second life marketplace has absolutely no right to ask you to cover any expenses.

Thanks for the replies guys, it appears they did remove it from the site since the link no longer works though I haven't received a follow up notification from them.

it is the first time this happens to me so I was very concerned about the licensing and got scared when they mentioned paying attorney fees.

Thanks to CGtrader the thief get banned but the product still is on their market !

I had the same problem. Some of my older models were stolen and posted on that market. I remember I sent emails to them, then realized they had a form for sending a DMCA copyright complaint. At the time, however, they were asking anyone who had a complaint to print out the form, fill it out, then mail it back to them via old fashioned snail mail.

Anyway, that marketplace has always been a haven for stolen models. My situation was about 5 or 6 years ago. The situation was resolved back then but I'm sure some of my models are still up there somewhere. I don't even bother looking anymore.

Unfortunately, this problem is one of the bad sides of this industry. No matter how much effort is put into preventing this, this problem continues and will continue.

I was just wondering about the topic motivated by a full highly detailed train model that's being sold for 19 bucks, interior and exterior. Of course I searched for similar models and found some with fair price 10x higher. So, even considering that's legit work, this people ruins the market. Conclusion, we that spent hours creating cg content have to deal with two main plagues: thieves and bottom scrapers. Sorry guys, this is really annoying

Yep. It's definitely a long-standing issue that has destroyed the profit margins in this industry. Maybe not for large, corporate sellers but certainly for the independent or freelance types of artists. There's absolutely no way to keep up with the thieves and track down the stolen items. I wouldn't have even known that my stuff was out there if it were not for some ethical folks with a keen eye letting me know.
