Can i use free models in my game. And i wanted to make it commercial so can i use it?

I've noticed a few models advertised as Royalty Free that are clearly copies of models from well known games (and I would assume are copyrighted by that game company). If a customer buys one of these models to use in their own game, assuming it is royalty free (since that is how it is advertised here), who is liable for both the copyright legal costs and the costs to the new game developer if the original game company decide to sue?
That customer could basically become subject to legal notice from that first game company, probably even get lawsuit and demand for compensating damages. But the customer can prove he has purchased a legal license though a well know and trusted platform. However, the license will get proven to be fraud and at that point the customer becomes aware having fallen victim to fraud and report this, all this will then get subject to the case and all damages then will eventually fall to the one committing the actual fraud in the first place (the bad seller, not CGtrader because they explicitly tell in user agreement seller is not allowed to publish someone ells copyrighted materials). In most cases tings probably just get settled between the parties involved, fraudulent seller will get banned and customer stops using the models and gets refund. But if a legal case has been opened then I imagine someone will eventually need to pay the damages, in that case the fraud seller (illegal sub-licencer) will have very bad day and lots of debt. It’s just bad for everyone involved so if you come across those type of models you better report it to staff, its bad for reputation of this platform and in extension to genuine sellers on it, staff will investigate and take that type of sellers down.

If it has standard royalty free license attached, then yes commercial use is allowed, artists needs to add custom license if they would like to restrict to non commercial use.
Also keep in mind if editorial license is attached, third parties can impose additional terms on commercial uses.
