Hello,
I created this 3d model from scratch. I did not take that creators model. I would never do a thing like that. That would be immoral.
It may look similar, because the Lego Minifigure with a smiley face, blue pants, and red shirt, is classic for a default Lego Minifigure. If you search online for, Classic Minifigure, or, default Minifigure, You will see others like it.
Also if you search on other 3d model sites, Like Turbosquid for instance, for Lego Minifigures, you will see that other 3d artists sell Lego Minifigures that look similar.
Also my 3d model doesn't have details, Like the holes in the legs, and rotating pieces in the arms. The face texture is also slightly different.
I also have a Sketchfab account, and I uploaded my Lego Minifigure, that I created:

If you check out my Lego Minifigure on Sketchfab, and inspect the model, you can click on the wireframe preview. And you will see that the topology is totally different then the other one.
